Hardship Requirements for 401k Withdrawals

  • Medical expenses: Costs described in Code section 213(d) incurred by you, your spouse, dependents (as defined in Code section 152, as in effect before January 1, 2005), or your beneficiary.
  • Home purchase: The cost of buying your principal residence (excluding mortgage payments).
  • Educational expenses: Tuition and related fees for the next 12 months of post-secondary education for you, your spouse, children, dependents, or your beneficiary.
  • Eviction prevention: Funds needed to prevent eviction from your principal residence or foreclosure on the mortgage of your principal residence.
  • Funeral expenses: Costs for funeral or burial expenses for your deceased parent, spouse, child, dependent, or beneficiary.
  • Home repair: Expenses to repair damage to your principal residence that would qualify for a casualty loss deduction under Code section 165 (without regard to whether it exceeds 10% of adjusted gross income).

Supporting Documentation

  • Medical expenses: Itemized medical bills, invoices, statements from healthcare providers, insurance statements showing coverage and out-of-pocket costs, and a letter from a healthcare professional detailing the necessity of the treatment.
  • Home purchase: Purchase agreement, closing documents, and proof of payment excluding mortgage payments.
  • Educational expenses: Official tuition bills, statements from the institution, records of scholarships or financial aid, and receipts for textbooks and supplies.
  • Eviction prevention: Official eviction or foreclosure notices from your lender or landlord, and correspondence regarding attempts to negotiate payment arrangements.
  • Funeral expenses: Invoices or receipts for funeral or burial costs.
  • Home repair: Estimates or invoices for repair costs, and documentation showing the damage qualifies for a casualty loss deduction.
